Behavioral Standards

BittyBay provides instant chat messaging in which you may communicate with other persons from around the world.

By using these instant messaging capabilities, you agree that you will not:

1. Abuse, harass, threaten, stalk, or otherwise violate the safety, security and/or rights of others regardless of race, gender, beliefs or other characteristics or opinions;
2. Violate our code of conduct;
3. Use the chat rooms in connection with junk or unsolicited email, chain letters, surveys or questionnaires, ‘business opportunities’, advertisement of other virtual communities;
4. Distribute inappropriate, unacceptable or unlawful material including any material likely to cause harm or offence, such as acts of violence, sexual acts, material perpetrating hatred or violence towards any individual or group of individuals;
5. Distribute material in breach of copyright or ownership laws and regulations;
6. Distribute files that contain any harmful computer viruses, Trojan horses, worms, corrupted files or any similar programs;
7. Distribute any individuals’ personal information or details;
8. Impersonate any individual;
9. Advertise or sell any goods or services;
10. Refuse instructions from any BittyBay personnel or legal authority;
11. Attempt or obtain unauthorized access to BittyBay’s, BittyBay affiliates’ or BittyBay personnel’s computer systems or databases;
12. Break the law.

Your Security

The security and use of your accounts and passwords with us is purely your own responsibility. You must keep this information safe and secure and from unauthorized access. If you have reason to assume your account details have become available to another person, it is your duty to contact us so that we can take appropriate steps of prevention.

No BittyBay user has authority to allow any other person(s) access to their account. All accounts are personal and to be used by the initial registrant. Any ‘shared accounts’ will be removed from our service without notice or refund.

BittyBay can reset your password upon your request. We will only do if we are provided with adequate information to ensure you are the correct account user.

Registration Age

To use BittyBay, you must be 13 years of age or older. Our service is not intended for the use of anyone under the age of 13 and we reserve our right to completely disable access to our service to any user determined to be under our minimum age requirement.

Services

BittyBay will from time to time offer “extra” services to its users which are subject to charge. Such services include but are not limited to “Bits”, participation in games or events, avatars and items which are used to decorate private rooms/”territories”. You agree that by purchasing these additional services that they will remain the property of BittyBay at all times and cannot be re-produced, distributed, sold or downloaded to your personal computer. By purchasing these “extra” services, you are purchasing the right to use them on the BittyBay client; you do not own any rights to the aforementioned items. Purchased items cannot be refunded and BittyBay reserves the right to remove such items from your account at any time and for any reason. Should BittyBay no longer continue to provide these services, users who have already purchased access to “extra” services are not entitled to any reimbursement or refund.

Should you purchase a physical product(s) from BittyBay, you are entitled to a full refund if you are not completely satisfied with your purchase given that the item(s) is in its original/saleable condition and has been purchased in the last 7 days. Any virtual items purchased from BittyBay will remain on the BittyBay server(s) and you may access these items when you visit the BittyBay website subject always to your compliance with these Terms and Conditions.

Permission is required from the account holder prior to making any purchases. If a purchase is used/redeemed and payment is withdrawn, or if a purchase is made without the permission of the account holder, the account that used/redeemed the purchase will be permanently removed from our website and services.

Your Account

By registering an account with BittyBay you agree that all information provided is correct and valid. It is your responsibility to contact us if any changes take place in regards to the details initially provided.

If you forget or lose the password to your account, you must contact us for a replacement password. In order to receive the replacement password, you must first satisfy a number of security checks that confirm whether you are the original account holder. BittyBay reserves the right to suspend account usernames and/or passwords if we consider there to be, or likely to be a breach of security in relation to the account in question.

By using the BittyBay website and/or registering an account with BittyBay, you agree that you will provide your own means of access (For example, your own Internet connection). BittyBay will not be held responsible for any costs that you may incur whilst visiting the website or using our service(s).

Should your account be compromised, any virtual items/possessions associated with the account cannot be refunded or reimbursed. However, any “Bits” that remain on the account can be transferred to a new one at your discretion. This process can only be completed if you are able to provide us with the appropriate details to verify the ownership of the account.

BittyBay reserves the right to ban/delete any account, for any reason and at any time without warning.

Inactive Accounts

From time to time, BittyBay may delete user accounts that have been inactive for over 6 months. To ensure your account is not deleted, make sure you log in at least once every 6 months. Any items or “Bits” available on inactive accounts of six months will be forfeited and no refunds will be made.

These measures are to ensure the upkeep and server space to maintain our services.

Commercial Use

BittyBay is intended solely for the use of individuals for recreational purposes. Commercial use of our service is not permitted under any circumstances.

Website Content

All material on the BittyBay website including images & graphics, text, software, music & sound, website design and all other content remains the exclusive property of BittyBay and is Copyright 2007 with all rights reserved.

You may not reproduce, modify, copy, publish, transfer, licence, or distribute any content on our website without the express written permission of the management board. If you are unsure as to what and how our content may be used, contact us.

Technical Access

You may not attempt to gain any unauthorized access to our computer systems, databases or any other private or hidden information.

You may also not use any third party tools or software to attempt to modify our service such as hacking or scripting tools or other devices intended to cause harm to our service.

Bug Abuse

You must not use or attempt to use any bugs or errors which you find in our software. Any exploits which you find must be immediately reported to BittyBay through Player Support.

Third Party Links

BittyBay may often present links on our website to third party organisations, businesses or websites. We accept no responsibility for any content or any damage caused upon the redirection to these websites.

Privacy

BittyBay’s Privacy Policy is a part of the Terms & Conditions.

Our Liability

You agree that BittyBay and all of our staff and employees are not and will not be responsible for any incidental, indirect, coincidental losses or damages including any economic loss through any action or usage of our website or services.

BittyBay does not condone, control or endorse any content that may be found in any chat room or message board and therefore does not hold any responsibility for the consequences that may arise from such content.

Subject to Change

BittyBay reserves the right to modify these conditions at any time without warning. Following any modifications, a notification may be noted on our website. Any changes will be effective immediately. If you do not agree to any changes or modifications made, you are no longer entitled to use our service.

Protection

You agree that you will not hold BittyBay, any BittyBay staff member or affiliate responsible for any damage, loss, expense, penalty or legal cost(s) that may arise from:

• Your breach of our Terms & Conditions and Privacy Policy;
• Any use or alleged use of the BittyBay website under your username and password, whether or not authorized by you;
• Your use of the BittyBay website, and;
• Your violation of any law or any third party law.

Legal

These Terms of Service are governed by the laws of the United Kingdom. You agree to submit any dispute in connection or arising from these terms or our website and services to the jurisdiction of the courts of the United Kingdom.
